replace pkg_resources

pkg_resources has been removed from Setuptools. Most common uses of pkg_resources have been superseded by the importlib.resources and importlib.metadata projects.

It's been deprecated since setuptools 67.5.0 (March 2023), see also pypa/setuptools#3085

this causes CI to fail:

i've added a temporary fix to restrict the setuptools version in e9a3c3c , but it should really be replaced.
